I always believed
that being a mother was the most important job in the world. This is what I was
taught. I was a good kid. I went to school, graduated and went out and started
a career.
I did as a good girl is supposed to do. I met a guy got
married and had a child. I gave up my career making 13.00 dollars an hour to
stay home and be the wife and mother so he could advance his career.
Of a 22 year relationship I was a stay at home wife, and
mother for 11 of those years. On our anniversary he came off the boat grabbed
his stuff and moved in with his girlfriend. I learned very fast that being out
of the work force for that many years is worse than trying to get a first job
right out of high school. I am seen as having less experience than a kid, this
makes it very hard to find a job.
In the process of working on my divorce I have begun to
learn about many of our laws. RS14:72 is a law protecting the spouse that stays
at home to raise the family.
§74. Criminal neglect of family
A.(1) Criminal neglect of family is the desertion or
intentional nonsupport:
(a) By a spouse of his or her spouse who is in destitute or
necessitous circumstances; or
(b) By either parent of his minor child who is in
necessitous circumstances, there being a duty established by this Section for
either parent to support his child.
(2) Each parent shall have this duty without regard to the
reasons and irrespective of the causes of his living separate from the other
parent. The duty established by this Section shall apply retrospectively
to all children born prior to the effective date of this Section.
(3) For purposes of this Subsection, the factors considered
in determining whether "necessitous circumstances" exist are food,
shelter, clothing, health, and with regard to minor children only, adequate
education, including but not limited to public, private, or home schooling, and
comfort.
Having not worked in 11 years I am considered below a high school
kid in experience. It has taken me almost a year to find some place willing to
give me a chance.
Being a good little democrat I went to the local DA for help. I
was told that if I could work then get a job I am not deserving of this law
being enforced. Mr. republican DA Joe
Waitz and his assistant DA Ellen are not interested in the point that the law
is in place to help people like me. I have been made to feel worthless because
I stayed home.
